General conditions of My L'Etudiant - L'Etudiant
Preliminary remark: these conditions must be accepted by the User to have access to the Personalized Spaces. This charter describes the conditions under which the Internet user can create an online account by identifying himself (hereinafter "Personalized Spaces"), accessible on the letudiant.fr site (hereinafter "the Site"), edited by The Student.
General Terms and Conditions of Use
L'ETUDIANT, a simplified joint-stock company with a single shareholder with a capital of 7,075,161.32 euros, whose head office is located at 77 rue Marcel Dassault 92 100 Boulogne -Billancourt, registered with the RCS of Nanterre under number 814 839 783, (hereinafter "the Student"), publishes a general information site www.letudiant.fr, hereinafter the "Site", allowing access to various information, as well as various additional services, detailed below.
In this regard, the Site offers the User:
– Consultation of content and information present on the Site.
– Different services, subject to registration and prior identification, allowing him to have access to a personal space by creating an account and to benefit from specific services (hereinafter the "Service(s)" ).
– Consultation of content and information present on the Site.
The Services include the following services in particular:
Free services allowing Internet users to create their own account (hereinafter “Personalized Space”) present on the Site, allowing them to:
– Subscribe to Newsletters.
– Receive personalized articles and job announcements.
– Take part in a contest.
– Access a dashboard
These general terms and conditions of use (“GTU”), subject to French law, are intended to govern the use of the Site. Browsing the Site and/or registering for a Service automatically entails express and unreserved acceptance of the T&Cs by the user of the Site.
The current T&Cs can be viewed at any time on the Site at https://my.letudiant.fr/cgu and can be downloaded and printed.
In the event of non-compliance by the User with the terms of these T&Cs, the Student reserves the right to take any measure likely to preserve his interests and in particular to ensure their execution. The Student may in particular assign the User of the Site for civil and/or criminal liability.
1 – Definitions common to the CGU/CGV
"Content" refers to all the information and publications accessible on the Site and in particular the general structure, the texts, the images animated or not, the videos , sounds, hypertext links of which the Site is composed; the distinctive signs, brands and logos constituting its graphic charter; and the associated databases as well as their contents, including in particular: textual or numerical data, graphics, tables, photos, videos, presentations hypertext links.
"User Account" means the space made available to the User registered on the Site, allowing him to access, after having identified himself by his connection identifiers, to the Services to which he has subscribed.
"User" means any Internet user connected to the Site.
2 – General conditions of use of the site (CGU)
2.1 Rights and obligations of the User
Conditions of participation
Creating a User Account
The Student allows any Internet user to open a User Account. When opening the User Account, the User undertakes to provide accurate, up-to-date and complete information in the Registration Form. The User must choose a user name, provide his e-mail address and indicate his situation (profile). Any entry of false, inaccurate, non-updated or incomplete information or of a user name containing inappropriate, disrespectful, defamatory, obscene or indecent terms, may give rise to the suspension and closure of the User Account.
The User will receive confirmation of the creation of his User Account in the form of an email sent to his mailbox. The registration confirmation email contains an unsubscribe link that allows him to unsubscribe if he is not at the origin of this registration.
The User is solely responsible for the use of his User Account without being able to oppose to the Student any fraudulent use by a third party. The User ensures the confidentiality of his login details.
User Identification
The User provides his e-mail address as well as a password allowing him to have access to his Personalized Space.
User Obligations
The User agrees not to:
– Use the proposed service for any purpose that contravenes regulations, public order and morality.
– Uploading, recording or transmitting elements that may infringe the rights of third parties.
– Uploading, recording or transmitting copyrighted materials, unless he warrants that he has obtained permission from the rights holder and can provide proof thereof.
– Uploading, recording or transmitting infringing elements or elements presenting a secret or confidential nature.
– Uploading, recording or transmitting elements presenting the character of unfair competition.
– Upload, store or transmit material containing trade or business secrets.
– Uploading, recording or transmitting obscene, violent, defamatory, threatening, malicious, abusive material against any natural or legal person, Service User or not, or inciting discrimination, hatred of a person or a group of persons, in particular because of their political opinions, their origin or their true or supposed membership or non-membership of a given ethnic group, nation, race or religion or their sexual orientation.
– Putting on line, recording or transmitting elements that may undermine the presumption of innocence of persons or the respect and authority due to Justice.
– Uploading, recording or transmitting elements of a pornographic nature and/or relating to child pornography or harmful to the protection of minors.
– Putting online, recording or transmitting elements that could undermine the security or integrity of a State or territory, that could incite the commission of an offence, a crime or an act of terrorism or that glorifying war crimes or crimes against humanity or inciting suicide.
– Upload, record or transmit advertisements or commercial solicitations, or classified ads of any kind.
– Upload, save, or transmit chain emails or pyramid-type information.
– Impersonate another person or another User.
– Uploading, recording or transmitting speculation or revelations concerning the identity of such or such User, or information of a personal nature such as addresses, e-mails, telephone numbers.
The User further agrees to:
– That his contribution does not contain any virus of any kind whatsoever, which could disrupt or damage in any way the Student's computer system.
– That his contribution relates to the theme of the debate treated in the commented article, and allows a constructive debate.
– Write messages in French and in lowercase letters.
2.2 Content moderation
The User remains fully responsible for the messages he publishes and the consequences that may result therefrom and guarantees the Student against any recourse and/or action in relation to these messages.
Right of alert or notification by any User
Any User has the option of alerting the Student, using the "Report abusive content" option, of any contribution considered to be non-compliant with this charter or, in general, with any French or Community legislation or regulations. The Student will be free to follow up on this alert, without the possibility of appeal by anyone.
Any User may also notify any contribution which appears to him to be inconsistent with these provisions, or in general with any French or Community legislation or regulations.
In the event that he decides to delete the contentious contribution or to deactivate access to the account at the origin of its publication, the Student declines all responsibility vis-à-vis the Users concerned.
Each User may also request the modification or deletion of his own messages by sending his request to the letudiant.fr site, indicating the precise address of the article, the chosen User name, the title of the message, the date and time of publication as well as any corrections to be made.
It is specified that this deletion or modification of messages can only be carried out by L’Etudiant on the letudiant.fr website, published by L’Etudiant; The Student not being able to act on search engines for which it is an automatic indexing which is not the responsibility of the Student.
Right to delete or terminate access to dialogue spaces
In the event of violation of the provisions of this charter, of any French or Community legislative or regulatory provision, or in the event that the Student considers that there is a violation of their material and/or moral interests, it reserves the right:
– to refuse the contribution of Users.
– and/or to remove any User contribution that has already been posted.
– to terminate the access rights of Users and to prevent their further access to the Dialogue Spaces.
– To close the commented area
L’Etudiant’s decisions cannot be challenged.
The Student's decisions may be notified to the Users concerned.
2.3 Use of content
The User accepts that his contributions within the framework of Public Dialogue Spaces become public information.
The User agrees that his contributions may be published, reproduced, modified, translated, distributed, presented and/or displayed, alone or associated with other works, in any form, medium or technology, currently known or unknown. .
The User grants other Users the right to access, display, record and reproduce the communications for their personal use, the Student being released from any liability in this regard.
3 – Intellectual property
The Student has exclusive intellectual property rights to all texts, comments, works, illustrations, photographs, images, videos, sounds, plans, names, logos , trademarks, creations and various protectable works, reproduced on letudiant.fr mobile sites and applications. As such and in accordance with the provisions of the Intellectual Property Code, only use for private use is permitted subject to different, even more restrictive, provisions of the Intellectual Property Code. However, the User is prohibited, outside of this use, from copying, reproducing, distributing, selling, publishing, exploiting in any other way and distributing in another format in electronic or other form the information present on the Site and applications. from letudiant.fr. Consequently, any other use constitutes an infringement and is sanctioned under intellectual property, except with the prior authorization of the Student.
Any total or partial reproduction of the Content of the Sites and applications of letudiant.fr is strictly prohibited.
The User therefore undertakes to:
– Do not download the Elements except for personal and time-limited use
– Do not print the Downloaded Elements on paper unless these copies are strictly limited to personal use
– Do not reproduce the digital version of the Elements for press review purposes
– Do not alter, modify, move, remove or replace the Elements.
It is recalled that the violation of the intellectual property rights of the Student constitutes an offense of counterfeiting punishable in France by the Intellectual Property Code.
The reproduction of one or more of the contents and services present on the sites of letudiant.fr, in their entirety or not, is subject to reproduction rights.
4 – Personal data
L'Etudiant, publisher of the Site and mobile applications under the L'Etudiant brand, respects the privacy of its Users. He agrees that all the information he collects to identify the latter, be considered confidential information.
The Student uses the personal information of its Users to enable the provision of the services it offers.
As such, the Student undertakes to comply with the regulations in force resulting in particular from the General Data Protection Regulation n ° 2016/679 of April 27, 2016 (GDPR). Each user can thus lodge a complaint with the CNIL, withdraw their consent and exercise their rights of access, rectification, opposition, forgetting, limitation and portability with the Student, 79, rue Marcel- Dassault, 92100 Boulogne-Billancourt, webmaster@letudiant.fr.
Requests must be submitted in writing and must be signed and accompanied by a photocopy of an identity document bearing the signature of the User. The request must specify the address to which the response must be sent. The Student will have a period of 2 (two) months to respond, following receipt of the request.
If the User has given his consent when registering, his personal data may also be transmitted to third party partners of the Student who may send him promotional messages likely to interest him.
5 – Use of cookies
When consulting our site letudiant.fr, cookies are placed on your computer, mobile or tablet. Our site is designed to be attentive to the needs and expectations of our readers.

6 – Warranties and Liability
The User uses the Student Services at his own risk. The Student cannot under any circumstances guarantee that the Services offered will not be interrupted. The Student's obligation to supply is limited to an obligation of means.
The Student agrees to make his best efforts to secure access, consultation and use of the Site in accordance with the rules of use of the Internet. Consequently, the Student cannot be held liable in the following cases (including in the event of damage suffered by third parties):
– Temporary interruptions of the Site necessary for its development, maintenance, or more generally in the event of updating certain files;
- Difficulties in the operation or temporary interruption of the Site beyond the control of the Student, in particular in the event of an interruption of electricity or telecommunications services;
- Failures or malfunctions of the Internet network in the transmission of messages or documents;
- Deletion, impossibility of storage, incorrect or untimely transmission of editorial content appearing on the Site.
The Services comply with the French legislation in force. The Student cannot be held liable in the event of non-compliance with the legislation of the country where the Services are used. It is up to the User to check with the local authorities the possibilities of using the Services to which he plans to subscribe. In addition, the User remains solely responsible for damages and prejudice, direct or indirect, material or immaterial as soon as their cause, foundation or origin is a use of the Site by themselves or by any person authorized by them to use this Site, whether such use is made in a fraudulent or non-fraudulent manner. He therefore expressly waives any claim or legal action relating to such damages and prejudices, on the basis of the contractual liability of the Student in his capacity as publisher of this Site or on any other basis. The User declares to accept the characteristics and limits of the Internet and, in particular, acknowledges:
– That he is aware of the nature of the Internet, in particular of its technical performance and response times for consulting and querying the editorial content of the Site;
– That the communication of his possible access codes and precisely his username and password or in general any information deemed confidential is carried out under his own responsibility;
– That it is his responsibility to take all necessary measures to ensure that the technical characteristics of his computer allow him to consult the Site;
– That it is his responsibility to take all appropriate measures to protect his own data and/or software from contamination by any viruses circulating through the Site.
In the event that the responsibility of the Student is sought due to a breach by a User of the obligations incumbent on him under the terms of the law or these T & Cs, the latter undertakes to indemnify the Student against any condemnation pronounced against it, this guarantee covering both the damages that may be paid and the related costs.
The Student's liability is limited to the sole offer of the Services and can in no way be engaged due to their use by the User.
7 – Force Majeure
A case of force majeure suspends the Student's obligations arising from the use or subscription to a Service.
The Student and no third party participating in the provision of the Service shall not be held liable in the event of failure or delay in the performance of their obligations under the T&Cs, resulting from causes beyond their control, at the including, without limitation, acts of God, acts of civil or military authorities, fires, floods, earthquakes, riots, wars, acts of sabotage, network failures, electronic file coding errors, software limitations or inability to obtain telecommunications services or government measures, provided, however, that the parties concerned take all reasonable measures to mitigate the effects resulting from the said situations.
8 – Autonomy of the clauses of the T&Cs
In the event that any provision of these T&Cs is deemed inapplicable under the law in force, the User and the Student agree to renegotiate in good faith in order to preserve the economic position they enjoy as close as possible to that mentioned under the provision rendered inapplicable. If they fail to replace this provision in a mutually acceptable and applicable manner, this provision will be excluded from the present CGU, and the rest of the general conditions will be interpreted as if the said provision were excluded and will remain applicable.
9 – Entire agreement
The T&Cs represent the entire agreement between the User and the Interactive Student relating to the subject matter.
10 – Changes to the T&Cs
The Student reserves the right to modify these T&Cs at any time, in particular to comply with any legal, jurisprudential, editorial and/or technical developments. The Student will inform the User of the modifications by e-mail and will invite him to agree to the modifications. In the event that the User does not accept the new T&Cs, he will no longer be able to use the Services.
11 – Applicable law – Jurisdiction
These T&Cs are governed and interpreted in accordance with French law. The language of these T&Cs is French. In the event of a dispute with professionals and/or traders, the courts of Paris (France) will be competent. In the event of a dispute with a consumer, the French courts will be competent. It is recalled that in application of the provisions of Article L. 141-5 of the Consumer Code, "the consumer may seize, at his choice, in addition to one of the courts with territorial jurisdiction under the Code of Civil Procedure, the jurisdiction of the place where he resided at the time of the conclusion of the contract or the occurrence of the harmful event”.
